1. General provisions
This Privacy Policy sets out the rules for processing and protecting personal data provided by users in connection with their use of the pomorskizakatek.pl website, in particular through the contact form. The Policy fulfils the information obligation arising from Articles 13 and 14 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR) and the Polish Personal Data Protection Act of 10 May 2018.
2. Data controller
The controller of personal data is:
FORTINO NIERUCHOMOŚCI BARTOSZ DUJ
ul. T. Bairda 56/4, 05-825 Grodzisk Mazowiecki, Poland
Tax ID (NIP): 9511834308, Business register (REGON): 368834384
email: kontakt@pomorskizakatek.pl
3. Data Protection Officer
The controller has not appointed a Data Protection Officer. For all matters concerning the processing of personal data you may contact the controller directly at kontakt@pomorskizakatek.pl.
4. How and why data is processed
Providing personal data through the contact form is voluntary but necessary in order to handle your enquiry, namely to arrange a private viewing of the Pomorski Zakątek development, carried out by the developer Słowinex Sp. z o.o., and to share its parameters.
Personal data (first name and surname, email address, telephone number, stated purpose of purchase) is processed on the following bases:
- Article 6(1)(a) GDPR: consent given by completing and submitting the form and confirming it through a link sent to the email address provided (a double opt-in mechanism);
- Article 6(1)(f) GDPR: the controller's legitimate interest in protecting the form against abuse (including limiting the number of submissions from a single IP address and anti-bot verification), which involves processing the IP address and technical browser data.
The submission is saved as pending confirmation and becomes active only after the confirmation link sent to the email address provided is clicked. Submissions not confirmed within 48 hours are automatically and permanently deleted. Data is not processed in an automated way, including profiling.
5. Retention period
- Submissions pending confirmation are kept for a maximum of 48 hours, after which they are automatically deleted.
- Confirmed submissions are kept for 12 months from the date of confirmation, in order to handle the enquiry and in case it becomes necessary to establish, pursue or defend against claims, after which they are automatically deleted.
- Consent to data processing may be withdrawn at any time by contacting kontakt@pomorskizakatek.pl, which does not affect the lawfulness of processing carried out before withdrawal.
6. Data recipients
Personal data may be shared with the following categories of recipients:
- entities cooperating with the controller on the Pomorski Zakątek development, to the extent necessary to handle a confirmed submission;
- the hosting and email service provider (dhosting.pl), to the extent necessary for the technical operation of the form and data storage;
- Cloudflare, Inc., the provider of the anti-bot verification mechanism (Cloudflare Turnstile), in respect of technical data (IP address, browser signals) processed to distinguish submissions from automated traffic;
- entities authorised to receive data under applicable law, at their request.
Cloudflare may process data on infrastructure located outside the European Economic Area; in that case the transfer takes place on the basis of compliance mechanisms provided for by the GDPR (for example standard contractual clauses).
7. Rights of data subjects
The data subject has the right to:
- access their data and obtain a copy of it;
- rectify (correct) their data;
- erase their data, restrict processing and object to processing;
- data portability;
- withdraw consent to data processing at any time, without affecting the lawfulness of processing carried out before withdrawal;
- lodge a complaint with the supervisory authority, the President of the Personal Data Protection Office, ul. Stawki 2, 00-193 Warsaw, Poland.
8. Security
The controller applies appropriate technical and organisational measures to ensure the security of the data processed, including an encrypted connection (HTTPS/TLS), restricted access to data and protection of the form against abuse. Despite the measures applied, transmitting data over the internet carries a risk inherent to that medium.
9. Cookies
The pomorskizakatek.pl website does not use its own cookies for analytics or marketing purposes. The fonts used to display the site are hosted directly on the controller's server, without the use of external font providers. The only external resource used by the site is:
- Cloudflare Turnstile, an anti-bot verification mechanism embedded in the contact form; according to the provider's documentation it does not use cookies for tracking purposes, but it may process technical browser data in order to verify that a submission does not come from an automated system.
More information about how this entity processes data can be found in its own privacy policy (Cloudflare).
10. Final provisions
This Policy applies from the date of its publication. The controller reserves the right to make changes to it, in particular in connection with changes in the law or the development of the site's functionality. The current version of the Policy is always available at pomorskizakatek.pl/en/privacy-policy.
